Terms and conditions of sale

Last updated: 3 November 2026

1. Who we are

These terms and conditions of sale (the "Terms") apply to any order placed on inviteto.fr with TOVA, a limited liability company (SARL) with share capital of €1,000, registered office 280 avenue du Prado, 13008 Marseille, France, Marseille Trade Register no. 944 883 156, EU VAT no. FR50944883156, which operates the brand InviteTo (hereinafter "InviteTo"). Contact: contact@inviteto.fr, phone 01 59 17 59 26 (standard rate).

2. Purpose and acceptance

InviteTo provides the customer with an online designer that allows them to design their digital invitation themselves, from A to Z (animated opening, card, invitation page, music, reply form). InviteTo hosts this invitation, collects guests' replies on the customer's private platform and, depending on the plan chosen, sends it to the guests by text message.

The invitation is designed by the customer alone: InviteTo does not proofread, correct, finalise or approve its content (wording, names, dates, times, venues, spelling, images).

The customer declares that they have the capacity to enter into a contract. They accept these Terms by ticking the box provided before payment; they prevail over any other document. The applicable Terms are those in force on the day of the order; they remain available and printable on this page.

3. Packages and prices

The same plans apply to private celebrations and business events:

Prices are shown in euros, including all taxes (20% VAT included). The Design + SMS Sending plan includes text messages up to the 100 included texts and any packs purchased: text-message sending is not unlimited. No additional charge is made without the customer's prior agreement; the customer buys any packs themselves. For recurring events, InviteTo can provide a quote on request.

4. Ordering

The customer designs their invitation in the online designer; a watermarked preview updates with every choice. Before confirming, they see a summary of their plan and the total price, and can go back to any step to correct their choices.

Before confirming, the customer checks their entire invitation in the preview: wording, names, dates, times, venues, addresses and spelling. What they confirm is what their guests will receive.

Clicking the "Confirm and pay" button constitutes an order with an obligation to pay. The contract is concluded upon receipt of full payment. The customer immediately receives confirmation of their order and access to their personal platform by email. InviteTo archives the order on a durable medium and keeps it available to the customer.

5. Payment

Payment is made online, in a single instalment, by card, on the secure page of our provider Stripe (PCI DSS certified). InviteTo never has access to card numbers. If online payment is temporarily unavailable, InviteTo sends the customer a secure payment link by email; work only begins after payment. An invoice showing the amount excluding tax and the VAT is provided to the customer, in the company's name for business customers.

6. Delivery and timescales

Guests' replies appear live on the customer's platform, and can be downloaded. The invitation remains accessible until 3 months after the event. InviteTo's timescales are suspended until the information or approvals expected from the customer are received.

7. Changes

The service is designed to be self-service: the customer designs their invitation and checks it fully before confirming their order. After payment, the customer may contact InviteTo from their platform to request the correction of a piece of information in their invitation (for example a typo, a time or an address). InviteTo makes it within reason, without proofreading or advising on the content; a request that would amount to redesigning the invitation (changing the design, the opening or all the wording) may be declined. The corrected invitation page remains available at the same link; texts already sent are not resent.

8. Right of withdrawal (consumer customers)

Consumer customers have a period of 14 days from the conclusion of the contract to exercise their right of withdrawal, without giving any reason. They simply need to send, before this period expires, an unambiguous statement by email to contact@inviteto.fr or by post to TOVA, 280 avenue du Prado, 13008 Marseille, France, using the form in the appendix if they wish. InviteTo acknowledges receipt without delay.

By confirming their order, the customer expressly requests that work begin as soon as payment is made, without waiting for the end of the withdrawal period. Consequently:

Any sums due are refunded within 14 days of withdrawal, using the same means of payment, at no cost to the customer.

9. Legal guarantees

Consumer customers benefit from the legal guarantee of conformity applicable to digital content and services. In the event of a lack of conformity (invitation not matching what was ordered, sending not carried out, page inaccessible), InviteTo undertakes to remedy it free of charge, within a reasonable time and without significant inconvenience to the customer; failing that, the customer may obtain a price reduction or termination of the contract. The customer may report any defect to contact@inviteto.fr.

10. Customer obligations

11. Intellectual property

InviteTo designs, ornaments, animated openings and music remain the property of TOVA. The customer receives the right to use and distribute their invitation for their event, with no limit on guests, including as an image or PDF. The watermarked preview in the designer may not be used until the order has been paid.

The customer remains the owner of their texts, photos, logos and music. They authorise InviteTo to use them solely to produce, host and send their invitation. InviteTo never publishes a customer's invitation as an example or on its social media without their written consent.

12. Personal data

The data of the customer and their guests is processed in accordance with our privacy policy. For guests' data, InviteTo acts as the customer's processor (Article 28 GDPR): it is used only for the event and deleted automatically 30 days after it.

13. Liability

InviteTo undertakes to provide the service with care and professionalism. It cannot be held liable for the content of the invitation designed by the customer (errors in wording, date, time or venue), for a text not received because of an incorrect number provided by the customer or filtering by the recipient's network, or for force majeure. Towards consumer customers, InviteTo's liability is as provided by law, and nothing in these Terms limits their statutory rights. Towards business customers, InviteTo's liability is limited to the amount paid for the order concerned.

14. Force majeure

Neither party is liable for a failure caused by an event of force majeure (for example a general outage of telecommunications networks). If the impediment lasts more than 30 days, either party may terminate the contract; the customer is then refunded for services not performed.

15. Cancellation

Apart from the right of withdrawal, the customer may cancel their order as long as the invitation has not been sent: they are refunded for the text-message sending and any unused text packs. If InviteTo cannot perform the service, the customer is refunded in full.

16. Customer service and complaints

For any question or complaint: contact@inviteto.fr, phone 01 59 17 59 26 or the contact form. We generally reply within 24 working hours, and within 7 days at most for a complaint.

17. Consumer mediation

In the event of a dispute not resolved after a written complaint to InviteTo, consumer customers may use a consumer mediator free of charge, within one year of their complaint. The name and contact details of InviteTo's mediator are available on request and will be shown on this page once its membership is finalised.

18. Governing law and disputes

These Terms are governed by French law, without depriving consumer customers of the protection of the mandatory provisions of the law of their country of residence. In the event of a dispute, the parties first seek an amicable solution. Failing that, consumer customers may bring proceedings before the courts of their place of residence. For business customers, the courts of Marseille have jurisdiction.
